The Right to Commerce

All trade within the city falls under the dominion of the Council Minor. One must hold an appropriate permit to even conduct trade (import/export) or find one to deal with who is authorized to conduct such commerce within the city. This includes the rights of merchants to conduct commerce within an establishment. In this manner the Council Minor over sees various guilds related to commerce and finance, mainly relating to the commoner class of individuals including those honored as Patrizio who may conduct and operate higher business, beyond craftsman and farmers plying their trade (whom still need appropriate permits for such business).

The Right to Bare Arms

All nobles have the right to bare arms (weapons) in the city, as do members of Ventura under legal contract with the city (whether that be City Guard or part of standing armies during times of conflict). It is accepted that conflict does happen between individuals in this context and the most forbidden act under this right is the taken of a life. This warrants a full investigation by the Wyvern Company into the matter. Continued conflict between individuals or groups outside of Vindicti also warrants investigation by the Wyvern Company. Vindicti falls under its own set of laws, which can be enforced by the Ventura Council only at the instigation of the Major Council, Vindicti is nearly a sacred right in the city of Matora.

The Right to Bank

Beyond commerce, this includes banking and exchange of finances. In order to assure the usury is kept in check, financial institutions are monitored by the Council Minor and this kept in check by the Major Council. Due mainly to the high level of finance that flows through Matora, this is a hot spot of activity among the noble families and the councils.

Jurisdiction and Arbitration

This relates to how disputes, charges, and allegations are handled including differences between commoners and nobles.

Jurisdiction is handled at the most base level by the Ventura company contracted to act as city guard. They serve as sheriff/magistrates for the city of Matora.

Commoner - Commoner

Commoners may approach any member of the Wyvern Guard wearing the official cloak of the city of Matora to request arbitration. The officer will then hear both sides in any dispute and pass judgement based on their understanding of the situation. Witnesses may be brought to bare, but this does not mean the officer needs to hear out this evidence.

If unable to decide, the officer may call for a Trial by Iron. Commoners that do not believe in the fairness of the arbitration of the demand for such a trial may placate to the Council Minor for a trial by jury. They will need to gain the backing of a noble house of the city and the jury will be assembled by the Council Minor. They have one week to meet these requirements to have a court appearance and trial in the Council Minor or must submit to single Trial by Iron.

Commoner - Noble

If a Noble charges a commoner of wrong doing or is in a dispute, this is automatically a trial by fire rather than any potential arbitration by the officer of the city guard. If the commoner wishes to placate to the Council Minor, they will need the support of a Great House of Matora; if they do not find the support, they are assumed guilty and sentenced to the stockade as determined by the officer.

Noble - Noble

In such a case of dispute or accusations between nobles, there are two possible solutions only. Trial by Jury or Trial by Combat. Trial by Combat determines the outcomes quickly while Trial by Jury includes the potential for time in the stockade.

Trials

Trial by Iron

The Trial by Iron is used to determine guilt or innocence. When conducted between two parties, iron rods are placed into a fire for a set length of time. Each party must then hold out their hand and grab the hot iron. The wound is bandaged by the officer of the trial and they will return in two days. If one should fester, this indicates the guilty party. If both are festering, the worse of the two is the guilty party. This is used to determine recompense by the officer.

If only one individual is under Trial by Iron, in the case of a commoner proving innocence against a noble, then only they must grab the iron. If in two days the wound is worse, the commoner is guilty.

Trial by Combat

This is only reserved for dispute between two nobles. The choice of combat must be agreed upon by both parties, including jousting, swords and other forms of combat. It is expected that the goal is nonlethal and is usually to first blood or knockdown. If by joust, the Piazza Spettacolo is the common ground to conduct this trial as it is the only place in the city prepared for two horses to charge. If other combat, the Piazza del Camp da Gioco (game court) may double, but the trial must be conducted in a court and not on the city streets itself. Vindicti is not a solution to such a dispute once brought to an officer of the city guard; however, it may lead to Vindicti should one house feel slighted in this trial.

Trial by Jury

Depending on who is involved, such a trial is turned over to either the Major Council (if nobles are involved) or the Council Minor (for commoners). In the case of a commoner making a plea for trial by jury, the onus of finding support from a noble house of Matora to support their case is on the individual. Failing to find backing to enter trial by jury returns as an admission of guilt and includes sentencing to the stockade.
